Terms of Service
Términos de servicio
1. Acceptance
These terms govern your use of the Arena Spanish School ("Arena", "we") website, student accounts and lessons. By booking a lesson, creating an account or using the site, you accept them. If you do not agree, please do not use the service. You agree that the contract is made electronically and that we may send you notices by email or WhatsApp. These terms are written in Spanish and English; if they differ, the Spanish version prevails.
2. What we offer
Live one-on-one and group Spanish lessons by video call, taught by native Nicaraguan teachers, plus practice exercises and materials for students. Lessons are online only. The length, content and price of each option are shown in the pricing section of the site.
3. Who can use the service
- People aged 18 or over can sign up for themselves.
- People under 18 can take lessons only if their mother, father or guardian signs them up, accepts these terms and is available to accompany the minor when needed.
- You need a stable internet connection and a device with a camera and microphone. The quality of your connection and equipment is not in our control.
4. Accounts
- You sign in with a one-time link sent to your email, or with a password if one was assigned to you.
- Keep your sign-in details private. You are responsible for activity on your account.
- Give us accurate information. We may deactivate an account that is misused; its history is kept as described in the Privacy Policy unless you ask us to delete it.
5. Booking, prices and payment
- Prices are the ones shown on the site when you book, in US dollars (USD).
- Prices include the taxes that apply in Nicaragua. We add no hidden charges. Your bank, PayPal or your country may apply fees, taxes or currency conversion that we do not control.
- If you pay in córdobas, the official Central Bank of Nicaragua exchange rate on the day of payment is used.
- Payment is made through PayPal or another method we agree with you. A booking is confirmed when we confirm it and receive payment. On request, we give you a receipt.
6. Packages, plans and validity
- Lesson bundles: lessons must be used within 3 months of purchase. If illness or another justified reason kept you from using them, write to us before they expire and we will review it in good faith (for example, with an extension).
- Monthly plan: you can cancel at any time; cancelling stops future billing.
- Group class: it runs when the stated minimum number of students is reached. If it is not, we will offer you another date or a refund.
7. Cancellations and refunds
See our Cancellation Policy, which is part of these terms.
8. First-lesson guarantee
If your first lesson isn't a great fit, it's on us. Tell us in writing within 48 hours after that lesson and choose between a refund of that lesson or a free trial lesson with a different teacher. It applies once per student and only to the first lesson you pay for.
9. Right of withdrawal (European Union and United Kingdom)
If you live in the European Union or the United Kingdom, you may have the right to withdraw from the purchase within 14 days. If you ask for lessons to start before that period ends, you will pay for the lessons already given and we will refund the rest.
10. How we expect you to behave
- Treat teachers and other students with respect.
- Do not record lessons, or share their links or materials, without the permission of everyone present. We do not record them either.
- Do not try to access other people's accounts, bypass security controls or disrupt the site. Such conduct may be a crime under Nicaraguan law.
11. Our teachers
Lessons are given by teachers who work with Arena. Arena sets the standards of the service and is answerable to you for it.
12. Intellectual property
The site, lesson materials and exercises belong to Arena or its teachers and are for your personal learning use. You may not copy or resell them. Teachers may upload only their own material or material they have permission to use; if you believe a material infringes your rights, write to us and we will review it and remove it if appropriate.
13. Testimonials
We publish student testimonials only with the student's permission. If you appear on the site and want your testimonial changed or removed, email us and we will do it.
14. Third-party services
To provide the service we use third-party platforms (video calls, payments, messaging). They are governed by their own terms and policies, and we do not control their availability.
15. Warranties and liability
We work to give good lessons and a reliable site, but we cannot promise a particular result, such as passing an exam or reaching a level by a date, because that also depends on your practice. We may have technical or maintenance interruptions. To the extent the law allows, our total liability to you is limited to what you paid for the lessons concerned. Nothing here limits the rights the law gives you as a consumer, or our liability for intentional harm or gross negligence.
16. Events beyond our control
Neither party is liable for failures caused by events beyond their reasonable control (for example natural disasters or general power or internet outages). In that case we will reschedule or refund the affected lessons.
17. Suspension and termination
We may suspend or close an account if these terms are seriously or repeatedly breached. Unless it is a serious breach, we will refund, pro rata, paid lessons you have not used. You may stop using the service and ask us to close your account at any time.
18. Changes to these terms
We may update them. The date above shows the current version. Changes apply going forward: they do not affect lessons you already paid for, which follow the terms in force when you bought them. If a change is significant, we will tell you by email.
19. Governing law and disputes
These terms are governed by the laws of the Republic of Nicaragua, including Law No. 842, the Consumer Protection Law. If there is a disagreement, write to us first: we will try to resolve it in good faith within 30 days. If it is not resolved, the parties may go to mediation and, failing that, to the competent courts of the department of Rivas, Nicaragua. If you are a consumer, you can also file a complaint with Nicaragua's consumer protection authority (Ministry of Development, Industry and Trade, MIFIC). If you live in another country, you keep the mandatory rights your local law gives you.
20. General provisions
These terms, the Privacy Policy and the Cancellation Policy are the entire agreement between you and Arena about the service. If any part is invalid, the rest stays in force. Not enforcing something at one time does not mean we give up enforcing it later.
21. Contact
No añadimos cargos ocultos.
16. Causas ajenas a nuestro control
